GENERAL BACKGROUND
Council Directive 96/35/EC requires Member States to implement legislation to ensure that certain undertakings who transport dangerous goods by road, rail and inland waterway, including the transport related activities of loading and unloading, appoint safety advisers.
Dangerous Goods Safety Advisers (DGSA) will need to have a vocational training certificate. The vocational training certificate will be mutually recognised in all Member States. The safety advisers are required to be appointed by 1st January 2000.
THE TRAINING, EXAMINATION AND CERTIFICATION OF THE DGSA
The detailed arrangements relating to the training, examination and certification regime will be dealt with by the Department of the Environment, Transport and the Regions (DETR).
The DETR have appointed the Scottish Qualifications Authority (SQA) to perform the duties of the Agent to the Competent Authority.
The vocational training certificate will be issued by the SQA on behalf of the DETR. It will be valid throughout the Member States of the European Community. It will be valid for five years from the date of issue. During the final year of its validity a DGSA may undergo a form of refresher training and successfully complete a further examination to confirm his knowledge in order that the certificate can be re-validated for a further five years.
There are no 'grandfather rights' based on previous knowledge or experience in the field of the transport of dangerous goods.
